This privacy policy applies to the following domains: schmitter-hydraulik.de, schmitter-hydraulik.fr and webshop.schmitter-hydraulik.de.

Data collection on our website

Who is responsible for the data collection on this website?

The data collected on this website are processed by the website operator. The operator's contact details can be found in the website's required legal notice.

How do we collect your data?

Some data are collected when you provide it to us. This could, for example, be data you enter on a contact form.

Other data are collected automatically by our IT systems when you visit the website. These data are primarily technical data such as the browser and operating system you are using or when you accessed the page. These data are collected automatically as soon as you enter our website.

What do we use your data for?

Part of the data is collected to ensure the proper functioning of the website. Other data can be used to analyze how visitors use the site.

What rights do you have regarding your data?

You always have the right to request information about your stored data, its origin, its recipients, and the purpose of its collection at no charge. You also have the right to request that it be corrected, blocked, or deleted. You can contact us at any time using the address given in the legal notice if you have further questions about the issue of privacy and data protection. You may also, of course, file a complaint with the competent regulatory authorities.

You also have the right, under certain circumstances, to request that the processing of your personal data be restricted. For details, please refer to the Privacy Policy under "Right to limit processing".

Analytics and third-party tools

When visiting our website, statistical analyses may be made of your surfing behavior. This happens primarily using cookies and analytics. The analysis of your surfing behavior is usually anonymous, i.e. we will not be able to identify you from this data. You can object to this analysis or prevent it by not using certain tools. Detailed information can be found in the following privacy policy.

You can object to this analysis. We will inform you below about how to exercise your options in this regard.

2. General information and mandatory information

Data protection

The operators of this website take the protection of your personal data very seriously. We treat your personal data as confidential and in accordance with the statutory data protection regulations and this privacy policy.

If you use this website, various pieces of personal data will be collected. Personal information is any data with which you could be personally identified. This privacy policy explains what information we collect and what we use it for. It also explains how and for what purpose this happens.

Please note that data transmitted via the internet (e.g. via email communication) may be subject to security breaches. Complete protection of your data from third-party access is not possible.

Notice concerning the party responsible for this website

The party responsible for processing data on this website is:

Schmitter Hydraulik GmbH
Represented by managing director: Andreas Meder and Matthias Richter
Am Stöckleinsbrunnen 1
97762 Hammelburg

Phone: 09732 8888 0
E-Mail: kontakt@schmitter-hydraulik.de

The responsible party is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (names, email addresses, etc.).

Revocation of your consent to the processing of your data

Many data processing operations are only possible with your express consent. You may revoke your consent at any time with future effect. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

Right to object to data collection in special cases and to direct advertising (Art. 21 DSGVO)

If the data processing is carried out on the basis of Article 6 paragraph 1 letter e or f DSGVO, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions. You will find the respective legal basis on which processing is based in this Data Protection Declaration. If you object, we will no longer process your personal data concerned unless we can prove that there are compelling reasons for processing which are worthy of protection and which outweigh your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims (objection according to Art. 21 Para. 1 DSGVO).

If your personal data are processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing, including profiling, insofar as it is connected with such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct advertising (objection under Art. 21 para. 2 DSGVO).

Right of appeal to the competent supervisory authority

In the event of infringements of the DSGVO, those concerned have a right of appeal to a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place where the alleged infringement was committed. This right of appeal is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only take place to the extent that it is technically feasible.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and for the protection of the transmission of confidential content, such as the inquiries you send to us as the site operator. You can recognize an encrypted connection in your browser's address line when it changes from "http://" to "https://" and the lock icon is displayed in your browser's address bar.
If SSL or TLS encryption is activated, the data you transfer to us cannot be read by third parties.

Information, blocking, deletion

As permitted by law, you have the right to be provided at any time with information free of charge about any of your personal data that is stored as well as its origin, the recipient and the purpose for which it has been processed. You also have the right to have this data corrected, blocked or deleted. You can contact us at any time using the address given in our legal notice if you have further questions on the topic of personal data.

Right to restrict processing

You have the right to request the restriction of the processing of your personal data. To do so, you can contact us at any time at the address given in the imprint. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we usually need time to verify this. For the duration of the review, you have the right to demand the restriction of the processing of your personal data.

  • If the processing of your personal data was/is unlawful, you may request the restriction of data processing instead of deletion.

  • If we no longer need your personal data, but you need them to exercise, defend or assert legal claims, you have the right to demand the restriction of the processing of your personal data instead of deletion.

  • If you have lodged an objection in accordance with Art. 21 Paragraph 1 DSGVO, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests outweigh the interests of both parties, you have the right to demand that the processing of your personal data be restricted.

If you have restricted the processing of your personal data, these data - apart from their storage - may only be processed with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

4. Data collection on our website

Cookies

Some of our web pages use cookies. Cookies do not harm your computer and do not contain any viruses. Cookies help make our website more user-friendly, efficient, and secure. Cookies are small text files that are stored on your computer and saved by your browser.

Most of the cookies we use are so-called "session cookies." They are automatically deleted after your visit. Other cookies remain in your device's memory until you delete them. These cookies make it possible to recognize your browser when you next visit the site.

You can configure your browser to inform you about the use of cookies so that you can decide on a case-by-case basis whether to accept or reject a cookie. Alternatively, your browser can be configured to automatically accept cookies under certain conditions or to always reject them, or to automatically delete cookies when closing your browser. Disabling cookies may limit the functionality of this website.

Cookies which are necessary to allow electronic communications or to provide certain functions you wish to use (such as the shopping cart) are stored pursuant to Art. 6 paragraph 1, letter f of DSGVO. The website operator has a legitimate interest in the storage of cookies to ensure an optimized service provided free of technical errors. If other cookies (such as those used to analyze your surfing behavior) are also stored, they will be treated separately in this privacy policy.

Please note that you can set your browser so that you are informed about the setting of cookies and can decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or generally. Each browser differs in the way it manages the cookie settings. This is described in the help menu of each browser, which explains how you can change your cookie settings. You will find these for each browser under the following links:

Please note that the functionality of our website may be limited if cookies are not accepted.

You can change the cookie preferences you set when you first visit our site at any time here.

Server log files

The website provider automatically collects and stores information that your browser automatically transmits to us in "server log files". These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The website is hosted in a German data center.

The collection of this data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and optimization of his website - for this purpose the server log files must be recorded.

Contact form

If you submit inquiries to us via our contact form, the information provided in the contact form as well as any contact information provided therein will be stored by us in order to handle your inquiry and in the event that we have further questions. We will not share this information without your consent

Hence, the processing of the data entered into the contact form occurs exclusively based on your consent (Art. 6 para. 1 lit. a GSDVO). You have the right to revoke at any time any consent you have already given us. To do so, all you are required to do is sent us an informal notification via e-mail. This shall be without prejudice to the lawfulness of any data collection that occurred prior to your revocation.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g. after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions – in particular retention periods.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b DSGVO, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a DSGVO) and/or on our legitimate interests (Article 6 (1) (f) DSGVO), since we have a legitimate interest in the effective processing of requests addressed to us.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Registration on this website

You can register on our website in order to access additional functions offered here. The input data will only be used for the purpose of using the respective site or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject your registration.

To inform you about important changes such as those within the scope of our site or technical changes, we will use the email address specified during registration.

We will process the data provided during registration only based on your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time with future effect. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

We will continue to store the data collected during registration for as long as you remain registered on our website. Statutory retention periods remain unaffected.

Processing of data (customer and contract data)

We collect, process and use personal data only to the extent that they are necessary for the establishment, content or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures. We collect, process and use personal data on the use of our Internet pages (usage data) only to the extent necessary to enable the user to use the service or to invoice the user. The collected customer data is deleted after completion of the order or termination of the business relationship. Legal retention periods remain unaffected.

The aforementioned statements also apply to the implementation of training courses, for which you can register via the website.

Data transmitted when entering into a contract with online shops, retailers and mail order

We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract, for example, to companies entrusted to deliver goods to your location or banks entrusted to process your payments. Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent.

The basis for data processing is Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.

Data processing for order processing

To process your order, we work together with service providers who support us in whole or in part in the execution of concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information. The personal data collected by us will be passed on to the transport company commissioned with the delivery within the framework of the contract processing, insofar as this is necessary for the delivery of the goods. Your payment data will be passed on to the assigned credit institute within the scope of the payment processing, as far as this is necessary for the payment processing. The legal basis for the transfer of data is Art. 6 para. 1 lit. b DSGVO.

Creditworthiness and transmission to credit agencies

In principle, we grant you the possibility to purchase goods using insecure payment methods (e.g. invoice, financing). Accordingly, we have a legitimate interest in protecting ourselves as well as possible against the occurrence of payment defaults. This is done, among other things, by checking the creditworthiness of the customer before granting the possibility of using uncertain payment methods. Within the scope of this check, we are entitled to use negative creditworthiness information that we ourselves have collected on the respective customer or received from a third party. The creditworthiness information is information about outstanding payment claims and information that directly indicates the risk of default (e.g. insolvency, debtor advice, deferral due to insolvency).

As part of the examination as to whether an uncertain method of payment can be granted, we are also entitled to obtain information on your creditworthiness and information on the likelihood of a fraudulent order (FraudPreCheck) from an external credit agency. We work together with the following credit agency: Creditreform.

For the purpose of calling up creditworthiness information, the following data in particular is transmitted to the external credit agency: First name, surname, postal address, date of birth.

Within the framework of the credit assessment, we can decide by means of an automated process whether you are granted the desired insecure method of payment (installment / invoice payment). For example, if a credit agency sends you a negative credit report, the desired payment method may be rejected automatically.

The processing of your data within the framework of the credit assessment is based on Art. 6 para. 1 letter b) DSGVO and Art.6 para. 1 letter f) DSGVO. In principle, we have a legitimate interest in carrying out a credit check when you select an insecure payment method (installment/invoice purchase).

5. Analytics and advertising

Google Analytics

This website uses Google Analytics, a web analytics service. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses so-called "cookies". These are text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

Google Analytics cookies are stored based on Art. 6 (1) (f) DSGVO. The website operator has a legitimate interest in analyzing user behavior to optimize both its website and its advertising.

IP anonymization

We have activated the IP anonymization feature on this website. Your IP address will be shortened by Google within the European Union or other parties to the Agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of the website, to compile reports on website activity, and to provide other services regarding website activity and Internet usage for the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with any other data held by Google.

Browser plugin

You can prevent these cookies being stored by selecting the appropriate settings in your browser. However, we wish to point out that doing so may mean you will not be able to enjoy the full functionality of this website. You can also prevent the data generated by cookies about your use of the website (incl. your IP address) from being passed to Google, and the processing of these data by Google, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

Objecting to the collection of data

You can prevent the collection of your data by Google Analytics by clicking on the following link. An opt-out cookie will be set to prevent your data from being collected on future visits to this site: Disable Google Analytics.
For more information about how Google Analytics handles user data, see Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.

Contract data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Archiving period

Data on the user or incident level stored by Google linked to cookies, user IDs or advertising IDs (e.g. DoubleClick cookies, Android advertising ID) will be anonymized or deleted after 14 months. The protection of your data is important to us, which is why we have additionally configured Matomo in such a way that your IP address is only recorded in abbreviated form. 6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we need an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data will not be collected or only on a voluntary basis. We use these data exclusively for sending the requested information and do not pass them on to third parties.

The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of the data, the e-mail address and its use for sending the newsletter at any time, for example by clicking on the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you have provided us with for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and deleted after you cancel the newsletter. Data that has been stored by us for other purposes (e.g. e-mail addresses for the member area) remain unaffected.

Newsletter dispatch with SendinBlue

We use the SendinBlue service to send newsletters. In Germany, the provider is SendinBlue GmbH, Köpenicker Straße 126, 10179 Berlin, a subsidiary of the French parent company SendinBlue SAS, 55 rue d'Amsterdam, 75008 Paris, France. SendinBlue is a service with which the newsletter dispatch can be organised and analysed. The data you enter for the purpose of receiving newsletters (e.g. e-mail address) is stored on SendinBlue's servers.
Our newsletters sent with SendinBlue enable us to analyse the behaviour of the newsletter recipients. Among other things, we can analyse how many recipients have opened the newsletter message and how often which link in the newsletter was clicked. All links in the email are so-called tracking links, with which your clicks can be counted.

If you do not want SendinBlue to analyse your email, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message. Furthermore, you can also revoke your consent at any time with effect for the future by e-mail.

The data you provide us with for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of SendinBlue after you unsubscribe from the newsletter.
For more details, please refer to SendinBlue's privacy policy at: en.sendinblue.com/legal/privacypolicy/.

We have concluded a corresponding contract with SendinBlue in which we oblige SendinBlue to protect our customers' data and not to pass it on to third parties.

Right of withdrawal at any time

You can cancel your subscription to the newsletter at any time. To do so, you will find a link at the end of each newsletter we send.
The legal basis of the processing for the newsletter dispatch is Art. 6 para. 1 lit. a) DSGVO.

7. Plugins and tools

YouTube with enhanced data protection

Our website uses plugins from the Google operated YouTube page. The site is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

We use YouTube in advanced privacy mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this site before they watch the video. However, the enhanced privacy mode does not necessarily preclude the sharing of information with YouTube partners. For example, whether you're watching a video or not, YouTube connects to the Google DoubleClick network.

When you launch a YouTube video on our site, it connects to the YouTube servers. This tells the YouTube server which of our pages you have visited. If you are logged in to your YouTube account, you allow YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube can store various cookies on your device after starting a video. These cookies enable YouTube to obtain information about visitors to our website. This information is used, among other things, to gather video statistics, improve the user experience and prevent fraud. The cookies remain on your device until you delete them.

Once a YouTube video has started, it may trigger further data processing operations over which we have no control.
YouTube is used in the interest of an attractive presentation of our online offers. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO.

Further information on the handling of user data can be found in the YouTube privacy policy at: https://policies.google.com/privacy?hl=en.

Google Maps

On our website we use Google Maps (API) from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Maps is a web service for displaying interactive (land) maps to visually present geographic information. By using this service, our location will be displayed to you and any approach will be easier.

Already when calling up those sub-pages in which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transmitted to Google servers in the USA and stored there. This happens regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in at Google, your data will be assigned directly to your account. If you do not want your profile to be associated with Google, you must log out before activating the button. Google stores your data (even for users who are not logged in) as user profiles and evaluates them. Such an evaluation is carried out in particular in accordance with Art. 6 Para. 1 lit. f DSGVO on the basis of Google's legitimate interest in the display of personalised advertising, market research and/or needs-based design of its website. You have a right of objection to the creation of these user profiles, whereby you must contact Google in order to exercise this right.

Google LLC, with its registered office in the USA, is certified for the US-European data protection agreement "Privacy Shield", which guarantees compliance with the data protection level applicable in the EU. If you do not agree with the future transmission of your data to Google in the context of the use of Google Maps, there is also the possibility of completely deactivating the Google Maps web service by switching off the JavaScript application in your browser. Google Maps and thus the map display on this website cannot be used in this case.

You can view the Google Terms of Use at https://policies.google.com/terms?hl=en&gl=en. The additional terms of use for Google Maps can be found at https://www.google.com/intl/en_US/help/terms_maps/. Detailed information on data protection in connection with the use of Google Maps can be found on the Google website ("Google Privacy Policy"): https://policies.google.com/privacy?hl=en&gl=en.

8. Custom Services

Job Applications

We offer you the opportunity to apply for a job with us (e.g. by e-mail, by post or via online application form). In the following we will inform you about the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data will be in accordance with the applicable data protection law and all other legal provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) to the extent that this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG-neu under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b DSGVO (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a DSGVO. Consent may be revoked at any time. Within our company, your personal data will only be passed on to persons involved in the processing of your application.
If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG-neu and Art. 6 Para. 1 lit. b DSGVO for the purpose of carrying out the employment relationship.

Data Archiving Period

If we are unable to make you a job offer, if you reject a job offer, withdraw your application, revoke your consent to data processing or request us to delete the data, the data you have submitted, including any remaining physical application documents, will be stored or retained for a maximum of 4 months after completion of the application process (retention period) in order to be able to trace the details of the application process in the event of discrepancies (Art. 6 Para. 1 lit. f DSGVO).

YOU HAVE THE OPTION TO OBJECT TO THIS STORAGE/RETENTION OF YOUR DATA IF YOU HAVE LEGITIMATE INTERESTS TO DO SO THAT OUTWEIGH OUR INTERESTS.

After expiry of the retention period, the data will be deleted, unless there is a legal obligation to retain the data or any other legal reason for further storage. If it is evident that it will be necessary to store your data after the retention period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when it no longer serves any purpose. Other statutory retention obligations remain unaffected.
